Is a Data Protection Impact Assessment (DPIA) required under the GDPR?
A DPIA is designed to help organisations systematically analyse, identify and minimise the data protection risks of a project or plan. It falls under the accountability obligations of the GDPR, and when performed correctly, it can help organisations assess and demonstrate how they comply with their data protection obligations. It is not aimed at completely eliminating the risks but instead it helps minimise the risks and determine whether or not the level of risk is acceptable in the circumstances.
Who needs to conduct a DPIA?
Under Article 35 of the GDPR, organisations must carry out a DPIA when the data processing is likely to result in a high risk to data subjects. Overall though, it is recommended for any business or organisation that wants to incorporate the GDPR principle of ‘privacy by design’ while processing of personal data or any other activity that impacts the privacy of individuals.
Why is a DPIA important?
Under the accountability principle of the GDPR, a DPIA is important to help businesses review and validate any gaps in noncompliance with their data protection obligations. While a DPIA is not aimed at completely eliminating the risks, it can definitely help minimise the risks and determine whether or not the level of risk is acceptable in the circumstances.
