Collusive Bidding Training

Collusive bidding is when competing suppliers agree to influence the outcome of a competitive contract tendering process, usually to manipulate the bidding processes and ensure the bid is won by a particular bidder. Some typical red flags of collusive bidding include similarities between bid documents, unusual price patterns, similar sub-contractors offered by multiple bidders, unexplained non-conformities and unusual bidding patterns. By training your employees on spotting the red flags, you can minimise the risks of breaching competition laws and preventing supplier fraud.

Collusion in business refers to two or more suppliers working together, often illegally and secretly, to their mutual benefit and to the detriment of their competitors. Legitimate businesses need to be very careful of accidentally falling foul of competition law in this way. Any agreements with competitors need to be thoroughly checked for legality.

Complementary bidding is when companies conspire to “rig” a bidding process by making sure one of their bids is noticeably stronger than the others. This can often be more subtle than bid suppression. The idea is that the winning bidders will return the favour with other companies’ preferred contracts.

Bid rigging can be proven either by the testimony of a witness or participant or by circumstantial evidence that has no other explanation. This includes suspicious bidding practices, withdrawal of bids late in the tendering process and strange pricing patterns. Companies should be alert for these red flags.
