This topic enables learners to uncover how to apply their knowledge of the Freedom of Information Act in a number of different situations, including requests for information and good records management.
Learners are tested on their knowledge throughout the course with short quizzes and feedback on the answers. The course concludes with a short assessment test where they will need to demonstrate their knowledge and understanding by answering 80% of the questions correctly to pass the course successfully. The Freedom of Information Act covers all recorded information regardless of what form it is recorded in or how long it has been held. The Act is designed to encourage openness and transparency in the way public bodies work, and to promote accountability in decision making and public expenditure.
Whenever public authorities receive a Freedom of Information (FOI) request, they must take care to respect the requirements of the Act whilst not breaching other legislation concerning privacy laws. Organisations must ensure that their employees are equipped with the knowledge and understanding to deal with FOI requests.
The Freedom of Information Act 2000 is designed to offer the public access to information held by public authorities. The Act works on the principles that members of the public are entitled to request information from public authorities and public authorities are obliged to publish certain information about their activities. Recorded information that can be requested includes printed documents, computer files, letters, emails, photographs, and sound or video recordings.
Any individual has the right to request information from a public authority. The only condition for the request to be valid under the Freedom of Information Act is that it must be in writing. A public authority normally has 20 working days to respond to a request. When responding to a request, authorities have two main duties – they must tell the individual whether they hold any information falling within the scope of their request and to provide that information.
As per the Information Commissioners Office (ICO), for a Freedom of Information (FOI) request to be valid under the Freedom of Information Act, it must be in writing. Essentially, any letter or email to a public authority asking for information is a request for recorded information under the Act.
